1. SCOPE AND PURPOSE
This Privacy Policy explains how 9432-4944 Québec inc. (the "Company", "LOK-8", "we", "us", or "our") collects, uses, discloses, stores and otherwise processes personal information in connection with Lok-8.me, Meretrouver.com, Reencuentra.me and related services (collectively, the "Service").
LOK-8 is designed as a flexible information-sharing and contact-facilitation service. It is not an identity-verification or identity-certification service. Users control much of the information placed in a LOK-8 profile and may, where permitted, use aliases, nicknames, pseudonyms, generalized descriptions, limited information, or omit information to reduce exposure of personally identifiable information.
This Policy distinguishes information that a User intentionally chooses to make accessible through a LOK-8 profile from information the Company collects privately to operate accounts, process transactions, deliver products, validate FREE accounts, secure the Service, provide support and comply with legal obligations.
2. CATEGORIES OF INFORMATION WE MAY COLLECT
Depending on how you use the Service, we may collect the following categories of information:
- Account and contact information, such as an email address, account identifiers, login and authentication information, language preferences and communications with us.
- Transaction and delivery information, such as purchaser name, billing-related information, shipping recipient, delivery address, order details and transaction records. Payment card information may be processed directly by a payment service provider rather than stored by LOK-8.
- FREE-account validation information, including information or codes reasonably required to validate eligibility, household limits or legitimate account use.
- Profile and User Content that you choose to enter, which may include names or aliases, photographs, descriptions, contact details, emergency contacts, medical information, accessibility information, special needs, messages, documents or other information.
- Location information supplied through a scanner's or visitor's device when that person permits location sharing after accessing a LOK-8 QR code or profile.
- Technical and usage information, such as IP address, browser or device information, session information, language, domain, timestamps, pages or functions used, security events and similar technical records.
- Cookie and referral information, including session, preference, analytics, security and authorized reseller/referral attribution identifiers.
- Support, security and fraud-prevention information, including correspondence, troubleshooting records and information reasonably needed to investigate suspected misuse.
- Reseller information, where applicable, including application, identity/business verification, payment and program-administration information governed additionally by the LOK-8 Reseller Agreement.
We seek to collect only information reasonably relevant to the purposes described in this Policy and to the functions selected by the User.
3. PUBLIC OR USER-SELECTED PROFILE INFORMATION
LOK-8 profiles are intentionally flexible. Except where a specific function or applicable law requires accurate information, profile information does not have to correspond to a person's legal identity.
A User may choose to use a first name, nickname, alias, pseudonym, generalized description or limited information, or may omit optional information. For example, a parent may decide not to display a child's legal name. Using an alias or limiting information in good faith to protect privacy is permitted.
Conversely, a User may voluntarily decide that accurate and detailed information is appropriate in a particular situation. Examples may include a serious or life-threatening allergy, a medical or accessibility condition, information concerning a non-verbal or vulnerable person, or the actual contact information of a parent, guardian, caregiver, family member or emergency contact.
Information that a User intentionally makes accessible through a LOK-8 profile may be viewed by persons who access the corresponding QR code, link, profile or other access method. Users should therefore carefully consider what information they choose to make accessible.
LOK-8 does not verify, authenticate or certify that profile information is true, complete, current, medically accurate or associated with the legal identity of the person described. The appearance of information in a LOK-8 profile is not a confirmation of its accuracy by the Company.
4. PRIVATE ACCOUNT, TRANSACTION AND OPERATIONAL INFORMATION
Information provided to the Company for account administration, billing or payment processing, shipping or delivery, FREE-account validation, fraud prevention, security, customer support, reseller verification, legal compliance or similar operational purposes is not made public merely because it is provided to LOK-8.
Where accurate information is reasonably required to perform one of these functions, Users must provide information sufficient and accurate for that purpose. For example, a physical product requires a usable delivery address, and account validation may require information sufficient to complete the applicable validation process.
The Company does not intentionally publish private billing, transaction, authentication, validation or internal security information as part of a User's public profile unless the User separately and intentionally chooses to place particular information into a public or accessible profile field.
5. HOW WE USE INFORMATION
We may use personal information for purposes reasonably connected with the Service, including to:
- create, administer, authenticate and secure accounts;
- provide and maintain profiles, QR-code functions and User-selected features;
- process orders, payments, memberships and transaction records;
- personalize, manufacture, fulfill, ship and support physical product orders;
- validate FREE accounts and enforce legitimate account, household, quota and trial rules;
- provide GPS position-sharing functionality when a scanner or visitor authorizes location sharing;
- send service-related communications, confirmations, security notices and support responses;
- operate, troubleshoot, analyze, maintain and improve the Service;
- detect, investigate and prevent fraud, abuse, security incidents and unauthorized activity;
- administer authorized reseller/referral attribution and related program records;
- comply with legal, regulatory, accounting, tax and dispute-resolution obligations; and
- protect the rights, safety, security and integrity of Users, the Company, the Service and third parties.
Where applicable law requires consent for a particular collection, use or disclosure, we will seek that consent in the manner required by law.
6. GPS POSITION SHARING AND LOCATION INFORMATION
LOK-8 products do not contain a GPS tracking device and do not independently or continuously determine, monitor or transmit location.
When a person scans or accesses a LOK-8 QR code or profile, the Service may offer that person the option to share the location of the device being used. Location is collected only to the extent the device, browser, permissions and user choice permit it.
The resulting location may be approximate, delayed, unavailable or inaccurate. It may be used to provide the location-sharing function, notify or inform the applicable account User, maintain reasonable operational or security records, and address misuse or disputes where permitted by law.
A scanner or visitor may decline location sharing. LOK-8 does not guarantee that location information will be provided or that it represents the precise location of any person, pet, product or object associated with a LOK-8 profile.
7. COOKIES AND SIMILAR TECHNOLOGIES
We may use cookies and similar technologies for sessions, authentication, preferences, language selection, security, fraud prevention, functionality, analytics, performance and authorized reseller/referral attribution.
When a visitor follows an authorized reseller or referral link, a cookie or similar mechanism may temporarily associate that visitor with a referral identifier. If the visitor later registers, attribution information may be recorded in Company systems in accordance with the applicable reseller/referral rules.
Users can generally control cookies through their browser or device settings. Blocking or deleting certain cookies may impair authentication, preferences, security, referral attribution or other Service functionality.
Further details are provided in the LOK-8 Cookie Policy. Where applicable law requires consent before using a particular category of cookie or similar technology, the Company will seek that consent as required.
8. WHEN WE MAY DISCLOSE INFORMATION
We may disclose personal information only as reasonably necessary for the purposes described in this Policy, with consent where required, or as otherwise permitted or required by law.
This may include disclosure to service providers that help us provide hosting, infrastructure, communications, payment processing, order fulfillment, shipping, analytics, security, technical support or other operational services. These providers receive information relevant to the services they perform and are subject to applicable contractual and legal obligations.
We may also disclose information where reasonably necessary to comply with law, court orders or lawful governmental requests; establish, exercise or defend legal rights; investigate fraud, abuse or security incidents; protect Users or third parties; or in connection with a legitimate corporate transaction, subject to applicable law.
Information intentionally made accessible by a User through a LOK-8 profile is disclosed according to the access configuration and functionality selected by that User. Once information has been accessed by an independent third party, that person's subsequent actions may be outside LOK-8's control.
9. RESELLERS AND REFERRAL RELATIONSHIPS
A reseller or referral relationship does not give a reseller ownership of, control over or general access to a referred customer's personal, medical, emergency, payment or private account information.
LOK-8 may process referral identifiers and transaction-related eligibility information as necessary to administer the reseller program, determine attribution and calculate or administer eligible commissions under the separate LOK-8 Reseller Agreement.
Resellers must not collect, access or use customer information through LOK-8 except to the extent expressly authorized by the Company, the customer and applicable law.
10. INFORMATION ABOUT CHILDREN, DEPENDANTS AND OTHER PERSONS
A User may create or manage information relating to a child, dependant, family member, vulnerable person, pet or another person where the User has the lawful authority or appropriate consent to do so.
Because LOK-8 profiles are flexible, a parent or guardian may choose to minimize a child's publicly accessible information, including by using a nickname, alias or limited description rather than a legal name.
Where a User provides medical, emergency, contact or other personal information concerning another person, the User is responsible for having the authority or consent required to provide and make that information accessible.
LOK-8 does not require Users to publicly expose more information than they choose to provide merely because a profile concerns a child or vulnerable person. Users should consider the sensitivity and practical necessity of each item before making it accessible.
11. SECURITY
We use reasonable administrative, technical and organizational safeguards appropriate to the nature of the information and the Service to protect personal information against unauthorized access, use, disclosure, alteration or loss.
No website, database, transmission method or storage system can be guaranteed to be completely secure. Users are responsible for protecting their account credentials and for carefully selecting information they intentionally make accessible through a LOK-8 profile.
If we become aware of a privacy or security incident, we will assess and address it in accordance with applicable legal obligations.
12. RETENTION AND ACCOUNT CLOSURE
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, for legitimate operational needs, or as required or permitted by applicable law.
Retention periods may vary according to the type of information. Transaction, accounting, tax, fraud-prevention, security, dispute and legal-compliance records may need to be retained after an account is closed.
When information is no longer reasonably required and no legal basis requires or permits continued retention, we may delete, anonymize or otherwise securely dispose of it in accordance with applicable practices and law.
Account closure does not necessarily result in immediate deletion of every backup, transaction, security or legally required record.
13. STORAGE, SERVICE PROVIDERS AND CROSS-BORDER PROCESSING
LOK-8 may use service providers and technological infrastructure located in Canada or other jurisdictions. As a result, personal information may be stored or processed outside Québec or outside Canada, depending on the providers and services used.
When personal information is processed in another jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to courts, law-enforcement or governmental authorities where legally authorized.
The Company will take measures required by applicable law when using service providers or communicating personal information outside Québec, including contractual, privacy and security measures where applicable.
14. YOUR PRIVACY CHOICES AND RIGHTS
Users can control much of the information made accessible in their LOK-8 profiles and may update, limit or remove optional profile information through available account functions.
Depending on applicable law and the circumstances, you may have rights concerning personal information held by the Company, including rights to request access or correction, withdraw consent where withdrawal is legally available, request information about processing, or exercise other privacy rights provided by law.
Some requests may be subject to identity or account verification, legal exceptions, retention obligations or limitations necessary to protect another person's rights.
To exercise an applicable privacy right, contact the Company using the information in Section 17. We may request information reasonably necessary to verify that the request relates to you or that you are authorized to act for the person concerned.
15. THIRD-PARTY LINKS AND SERVICES
The Service may contain links to, integrate with or depend on third-party websites, payment providers, maps, communications systems, browsers, devices or other services.
Those third parties may process information under their own privacy policies and terms. LOK-8 is not responsible for the independent privacy practices of third parties that are not acting as service providers on the Company's behalf.
Users should review the privacy information of third-party services they choose to use.
16. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect changes to the Service, our practices, technology or legal requirements. The updated Policy will identify a revised effective or last-updated date and will be made available through the Service.
Where applicable law requires advance notice, consent or another procedure for a material change, we will comply with that requirement.
